1. Agreement to Terms

By accessing or using AshWeb Inc.'s services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

3. Account Terms

3.1 Account Creation

  • Minimum age: 18 years
  • Accurate information required
  • One account per person/entity
  • Responsible for account security

3.2 Account Responsibilities

  • Maintain security of credentials
  • Notify us of unauthorized access
  • Liable for account activities
  • Keep contact information current

3.3 Account Termination

User-Initiated Account Deletion:

  • Account deletion requires prior suspension of all active services
  • Users must individually visit each service management interface and suspend services before requesting account deletion
  • Service suspension constitutes permanent ownership forfeiture to AshWeb
  • Account deletion requests will be rejected if any active services remain

Termination Process:

  • Submit deletion request through account settings
  • AshWeb reviews requests within 24-48 hours
  • Email confirmation required before final deletion
  • Account data retained for 90 days post-deletion as per privacy policy

4. Acceptable Use Policy

4.1 Permitted Use

You may use our Service to:

  • Build AI-powered subscription services
  • Manage customers and payments
  • Host legitimate business services
  • Integrate with approved third parties

4.2 Prohibited Use

You may NOT:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Distribute malware or harmful code
  • Engage in fraudulent activities
  • Abuse AI resources or rate limits
  • Resell service without authorization
  • Harass or harm others
  • Violate privacy rights
  • Engage in cryptocurrency mining
  • Create competing services

5. Payment Terms

5.1 Subscription Fees

  • Billed monthly or annually
  • Prices in USD unless specified
  • Automatic renewal
  • Prices subject to change (30 days notice)

5.2 Payment Processing

  • Processed via Stripe
  • Valid payment method required
  • Authorization for recurring charges
  • Responsible for taxes

5.3 Refunds

  • 30-day money-back guarantee (first payment)
  • No refunds after 30 days
  • Prorated refunds at our discretion
  • Refund policy applies

6. Service Terms

6.1 Service Availability

  • 99.9% uptime target (not guaranteed)
  • Scheduled maintenance with notice
  • No liability for downtime
  • Best effort support

6.2 Service Modifications

  • Features may change
  • Advance notice for major changes
  • No guarantee of backward compatibility
  • Right to discontinue features

6.3 Service Suspension and Ownership Transfer

Service Suspension by User:

  • Users may voluntarily suspend their services at any time through the account management interface
  • Service suspension constitutes immediate forfeiture of all control and ownership rights
  • Upon suspension, users permanently lose all access and management privileges for the suspended service
  • All administrative capabilities are immediately and permanently revoked

AshWeb Discretionary Management:

  • Suspended services may be maintained, transferred to other parties, or terminated at AshWeb's sole discretion
  • AshWeb reserves the right to continue operating suspended services if deemed beneficial
  • Service data and operations following suspension are handled according to AshWeb's business needs
  • No user consent or notification is required for post-suspension service management decisions

Legal Framework:

  • Service suspension represents complete ownership relinquishment under applicable law
  • Users acknowledge they have no future claims to suspended services
  • This ownership transfer is final and cannot be reversed
  • AshWeb accepts no liability for decisions made regarding suspended services

Customer Continuity:

  • Active user subscriptions in suspended services will continue until natural expiration
  • AshWeb may maintain service operations to honor existing customer commitments
  • Post-suspension service modifications are at AshWeb's discretion

6.4 Fair Usage Policy

Service Management Expectations:

  • Regular account management recommended for optimal service
  • Reasonable response to customer inquiries expected
  • Active maintenance of services with paying customers

Usage Guidelines:

  • AI features are designed for normal business operations
  • Platform reserves the right to implement reasonable usage limits during high-demand periods
  • Automated or bot-driven usage should be discussed with support team
  • Fair resource allocation may be implemented as needed

Acceptable Usage:

  • Services must provide legitimate value to end-users
  • Compliance with all applicable laws and regulations required
  • Respect for intellectual property rights mandatory
  • No creation of directly competing platforms

7. User Responsibility & Platform Limitations

7.1 Complete Operator Responsibility

Full Legal Responsibility:

  • Operators are solely and exclusively responsible for all legal, regulatory, and ethical compliance of their services
  • This includes but is not limited to: content legality, customer data protection, financial regulations, advertising standards, and industry-specific requirements
  • AshWeb provides technology infrastructure only - no business, legal, or compliance guidance whatsoever

Content and Service Liability:

  • Operators are fully responsible for all content, services, interactions, and outcomes generated through their applications
  • No monitoring, review, validation, or oversight of user services is provided by AshWeb
  • Platform access does not constitute any form of endorsement, approval, or support of user services

7.2 Prohibited Content and Services

Strictly Prohibited:

  • Adult content involving minors or non-consensual material
  • Unlicensed financial advice, investment recommendations, or trading signals
  • Medical diagnosis, treatment recommendations, or health advice
  • Illegal gambling, betting, or lottery services
  • Hate speech, discriminatory, or harassing content
  • Copyright-infringing or trademark-violating materials
  • Privacy-violating data collection or surveillance services
  • Any illegal, fraudulent, or deceptive practices

7.3 Platform Limitations

Technology Platform Only:

  • AshWeb provides infrastructure, hosting, and technical tools exclusively
  • No participation in, control over, or responsibility for actual service delivery
  • No liability for operator business decisions, pricing, customer service, or legal compliance
  • Platform availability does not constitute endorsement of any particular service or content

No Support Provided:

  • AshWeb does not provide legal advice, compliance guidance, business consulting, or dispute resolution services
  • Operators must consult their own legal counsel and professional advisors for all business-related matters
  • Account termination and service removal are AshWeb's only enforcement mechanisms

7.4 Full Indemnification

Complete Indemnification Required:

  • Operators agree to fully indemnify, defend, and hold AshWeb harmless from ANY and ALL claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees and court costs)
  • This indemnification covers all claims arising from or related to: operator's use of the platform, content created or distributed, customer interactions, legal violations, regulatory non-compliance, data breaches, privacy violations, intellectual property infringement, and any other service-related issues
  • Indemnification obligation survives termination of service agreement

7.5 AI-Generated Content and Tenant Legal Responsibility

Platform Provider Role:

  • AshWeb provides AI content generation tools as technical infrastructure only
  • All AI-generated content (images, text, audio, video) is the sole responsibility of the tenant operator
  • AshWeb does not monitor, review, moderate, or take responsibility for any AI-generated content created through tenant services
  • Tenant operators bear full legal responsibility for all content generated and distributed through their services

Tenant Legal Documents:

  • Each tenant service includes customizable legal documents (Terms, Privacy Policy, Refund Policy)
  • Tenant operators are REQUIRED to review and customize these documents for their specific service
  • Default templates are provided for convenience only and do not constitute legal advice
  • Tenant operators must ensure their legal documents comply with all applicable laws in their jurisdiction
  • AshWeb assumes NO responsibility for adequacy or compliance of tenant legal documents

Tenant Operator Obligations: Tenant operators using AI generation features MUST:

  • Clearly disclose to end-users that content is AI-generated where legally required
  • Implement appropriate age verification for mature/NSFW content
  • Comply with all applicable content regulations in their jurisdiction
  • Maintain proper content moderation and review processes
  • Respect intellectual property rights in AI-generated content
  • Implement appropriate content rating and access controls

Strictly Prohibited AI Usage:

  • Creating deepfakes or synthetic media intended to deceive or cause harm
  • Generating non-consensual intimate images or similar harmful content
  • Impersonating real individuals without proper authorization
  • Circumventing platform safety features or NSFW filters
  • Creating content depicting minors in any inappropriate context
  • Generating content that violates third-party intellectual property rights
  • Using AI to create illegal, fraudulent, or deceptive content

NSFW Content Management:

  • NSFW content generation features are provided as tools only, not as guarantees
  • Platform NSFW filtering is a safety feature, not a legal compliance solution
  • Tenant operators using NSFW features are solely responsible for:
    • Implementing proper age verification systems
    • Complying with adult content regulations in their jurisdiction
    • Maintaining appropriate content warnings and access controls
    • Managing any legal consequences of adult content distribution
  • AshWeb provides filtering tools but cannot guarantee complete NSFW prevention

AI Content Limitations:

  • AI-generated content is unpredictable and may contain errors, biases, or inappropriate elements
  • Tenant operators must review and validate content before public distribution
  • AshWeb makes no warranties regarding AI output quality, accuracy, or legal compliance
  • Content generation models are provided "as-is" without guarantees

Tenant Legal Independence:

  • Each tenant service operates as an independent legal entity
  • Tenant operators are solely responsible for their service's legal compliance
  • No attorney-client relationship exists between AshWeb and tenant operators
  • AshWeb does not provide legal advice regarding content, compliance, or operations
  • Tenant operators must consult their own legal counsel for all business matters

Complete Indemnification for AI Content: Tenant operators agree to indemnify and hold AshWeb harmless from ANY claims, damages, or liabilities arising from:

  • AI-generated content created through their tenant service
  • Failure to properly disclose AI-generated nature of content
  • NSFW or adult content distribution
  • Intellectual property violations in AI-generated content
  • Deepfakes or misuse of AI generation tools
  • Inadequate age verification or content controls
  • Non-compliance with content regulations
  • End-user harm or deception from AI-generated content
  • Any other consequences of AI content generation or distribution

8. Intellectual Property

8.1 Your Content

  • You retain ownership
  • Grant us license to operate Service
  • Responsible for content legality
  • Warrant right to use content

8.2 Our Property

  • Platform technology
  • Trademarks and branding
  • Documentation
  • AI models and algorithms

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10. Limitation of Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the Service operates, without regard to conflict of law principles.
